The presentation is designed to explore strategies for investigating and responding to employment claims, and identification of sensitive issues, including documenting issues which frequently arise during internal HR investigations. Explore how to identify work-related practices and policies which could be the focus of claims by litigants and their legal counsel, potential mistakes and strategies to avoid.

SPEAKER: THOMAS LUCAS AND LISA BERTINI

Tom Lucas is a partner with Jackson Lewis, a national labor and employment law firm. Tom represents management clients in the full range of labor and employment law matters, including employment discrimination and traditional labor law. He has practiced throughout the Mid-Atlantic Region and nationally on traditional labor issues for over 25 years. His clients include firms in the maritime, government contracting, manufacturing, healthcare and service industries. Tom has been recognized in Best Lawyers in America in Labor & Employment Law and Virginia’s “Legal Elite” and was recently elected as a Fellow in The College of Labor and Employment Law of the American Bar Association. Prior to going into private practice, Tom practiced as a Trial Specialist and in the General Counsel’s Office with the National Labor Relations Board.

Specialties: Labor & Employment Law – counseling and litigation on behalf of corporate clients in employment discrimination law. Training, counseling and representation of corporate clients in union campaigns, collective bargaining, arbitration and related litigation.

Lisa A. Bertini practices at the boutique employment firm of Bertini Law, PC in Virginia Beach, and specializes in employment discrimination work. She earned her J.D. from William & Mary Law School and her B.A. from Georgetown.  During the first half of her career she represented only employers and companies in employment litigation, but now specializes in representing employees.

Ms. Bertini’s practice is substantially dedicated to seeking to remedy workplace discrimination and to ensure that employees are treated in a non-discriminatory manner in the workplace. She has served as Bar Council for the Virginia Bar and is active in Virginia Employment Lawyers Association, National Employment Lawyers Association and is the Vice Chair of the Virginia Bar Association Employment and Labor Section Council. Ms. Bertini is the author of the chapter, Key Considerations for Plaintiff’s Attorneys in Employment Discrimination/Harassment Litigation in the book Inside the Minds: Representing Employees in Discrimination Cases (Thomson Reuters, 2012).

Ms. Bertini has been named one of the Top 25 Female Lawyers in Virginia for the last six consecutive years, one of the Top 50 Female Lawyers in Virginia for six consecutive years, as well as one of the Top 100 Lawyers in Virginia for the past four years by Super Lawyers Magazine.
