The Virginia General Assembly recently passed legislation that may alter the status quo for Virginia employers.

Join PenSHRM Member and Jackson Lewis Attorney, Tom Lucas, for an overview of these new laws, and how to prepare for the changes come as early as July 31, 2020.

  • Virginia Values Act – expands upon the Virginia Human Rights Act (VHRA) to include protections for sexual orientation and gender identity.
  • Wage theft law – creates a private cause of  action for employees to recover unpaid wages, with possible 3X damages.
  • Whistleblower statute –  private right of action for employees against retaliation for complaining to management.
  • Restrictive covenant law – prohibits restrictive covenants for lower-paid employees.

Tom Lucas is a partner with Jackson Lewis, a national labor and employment law firm. Tom represents management clients in the full range of labor and employment law matters, including employment discrimination and traditional labor law. He has practiced throughout the Mid-Atlantic Region and nationally on traditional labor issues for over 25 years. His clients include firms in the maritime, government contracting, manufacturing, healthcare and service industries. Tom has been recognized in Best Lawyers in America in Labor & Employment Law and Virginia’s “Legal Elite” and was recently elected as a Fellow in The College of Labor and Employment Law of the American Bar Association. Prior to going into private practice, Tom practiced as a Trial Specialist and in the General Counsel’s Office with the National Labor Relations Board.
